KSAMC Deputy Mayor - Major Difference in Circumstances Concerning Estatebridge & JACDEN’s As Built Applications

Deputy Mayor of Kingston and Minority Caucus Leader in the Kingston and St. Andrew  Municipal Corporation, Delroy Williams, has taken note of a statement issued by Mayor Andrew Swaby and the leadership of the Corporation concerning the approval by the Building Committee on Wednesday of 'As Built' applications made by Estatebridge Limited and JACDEN Limited.

Deputy Mayor Williams wishes to bring clarity and highlight the following facts.

  1. The statement from Mayor Swaby and the KSAMC Leadership failed to note that in the case of Estatebridge, the company had a permit and applied for approval of minor variations. This is a normal procedure concerning any construction of note.
  2. Concerning JACDEN, the entity did not have a permit for the building which was erected. JACDEN had applied for a permit to build a two storey commercial building. However, a permit was not approved.
  3. JACDEN proceeded to build a structure which exceeded the number of storeys particularised in their initial application. JACDEN then applied for regularisation. Prior to the building being regularized on Wednesday, the structure would have been contemplated in law as an illegal building.
  4. For the avoidance of any ambiguity, Estatebridge had a lawful permit and applied for regularisation of minor variations. In the case of JACDEN, a building was constructed without a permit and was subsequently regularised.

The above are the facts concerning the issues. 

Deputy Mayor Williams says it would be good if statements issued by Mayor Swaby and the leadership of the KSAMC are characterized by greater clarity.

  1. Mmmh! I haven't seen the other building, but when I saw the Jacden building I was wondering how come they putting such a high rise building there. everyone do as they please in JA.

  2. This seems to be a regular practice. It is disturbing though that no penalties were levied on the companies for the breaches committed by them, not as far as I have read.
    The horse going before the carriage is the style, I suppose. They act and then they apply. Shouldn't it be the other way around? You apply for desired changes and wait for approval before modifying the previously approved plan?
    The other company did not have a permit according to the deputy mayor but had one according to the current mayor? Confusing! Poor record keeping? As observed it appears to be the norm. They do it all the time.
    The Municipal Corporations need to have a team to regularly check on all approved permits to ensure they are compliant. Not some, not at the beginning but all at different stages of construction or as a follow-up. This way people will not see it necessary to sway away from the approved plan because nobody is coming to check.
    What are the penalties for these breaches under the law? It cannot be to get regularized if caught.
