Background
1.
On March 6, 2024 at about 11:30 am police, armed with a search warrant
in the name Nicholas Hibbert, the
accused, arrived at a targeted location in Central Village, in the
parish of Saint Catherine.

Upon their arrival, Mr. Nicholas Hibbert, who was standing at the gate of the premises
looked in the direction of the police and ran, attempting to lock himself
inside the premises.

The police who were now disembarking the service
vehicle, shouted “Police, don’t move!”
One of the police officers who disembarked from the vehicle prevented the
accused from bolting the grill by placing his hand over the section where the
bolt was located. The accused then ran inside the house and the police pursued
and caught up with the accused at the back of the dwelling house.

The man identified himself as Nicholas Hibbert o/c Dun Dun o/c Blacks and the warrant was
executed on him. The bedroom of the premises was searched in the presence of
Mr. Hibbert. The officers saw and searched a barrel in the room and found one
(1) black revolver. The revolver was removed from the barrel and it was discovered
that the revolver had six (6) rounds of ammunition.

The police also found one (1) silver and black pistol
with one (1) round of ammunition in the breach. That round was placed in a
magazine which had other cartridges in it.

The accused after the items were found said “officer please don’t kill me”. The
accused was cautioned and asked if he had a permit or license for a firearm and
he replied “no”. He also said to the police “annuh
mine offica.” The rest of the house was searched and nothing illegal was
found inside.

A search was conducted of the rear of the premises and
the police observed a knitted bag partially visible in the ground and used a
shovel, which was nearby, to big up the bag. The police dug up the bag and
found a rifle inside the bag. The accused was asked if he had a license and
responded by saying no.

The accused was escorted along with the firearms to the
Central Village Police Station where he was arrested and charged. The accused
was cautioned at the Police Station. On caution he said, “offisa mek me carry unnu guh show unnu weh one more deh and unnu give
me a chance.”
Arraignment
9.
Mr. Hibbert was indicted for Three (3) Counts of
Possession of Prohibited Weapon, One (1) Count of Unauthorised Possession of
Ammunition and One (1) Count of Stockpiling Prohibited Weapons.
10. Mr.
Hibbert pleaded guilty to all five (5) counts on the indictment on the 3rd
day of March, 2025 before the Honourable Mrs. Justice Lorna Shelly-Williams in
the High Court Division of the Gun Court.
Sentencing
11. Mr. Hibbert was sentenced on the 9th day of June, 2025 as
follows:
i.
Counts 1, 2, and 3 for the offences of Possession
of Prohibited Weapon- Twenty-One (21)
Years and Nine (9) Months Imprisonment. He is to serve Fifteen (15) Years
before being eligible for Parole.
ii.
Count 4 for the offence of Unauthorized Possession
of Ammunition- Life Imprisonment. He is
to serve Twenty Years (20) before being eligible for Parole.
iii.
Count 5 for the offence of Stockpiling Prohibited
Weapons
Life
Imprisonment. He is to serve Twenty-Five (25) Years before being eligible for
Parole.
The sentences are to
run concurrently.

Editor's Note
If we can remove those persons with illegal firearms from society, that should make a major difference to the level of crime in the country. Those imprisoned should not become a burden to the state. Let them work and pay for their stay in prison.
