There is the saying that a person is not guilty unless convicted in a court of law. If a court of law decides that you are not guilty and your conscience says you are, then you are guilty. If you are not found guilty by a court of law and the public has found you guilty, may the good Lord help you.
In the case of Melissa Silvera's death, it seemed to me that the thought of Melissa dying from a natural cause was a preposterous one in the first instance. Bark Di Trute did not buy that story, and this was made clear in our posts. Can the defendant be charged with public mischief and for misleading the court?
Jamaicans continue to be suspicious of the proceedings, especially since the case is being held in camera. The gun court law is outdated.
The court cannot stop the thousands of Jamaicans who are now discussing the case. The public has a right to see and know how justice is being dispensed in their country. While judgment takes place in a court of law, public judgment is very important.
Openness and public explanation can reduce the chasm between the prosecutor, the defender, and the judicial system. The former DPP Paula Llewellyn was excellent at communicating with the people. She epitomizes the concept of being a servant of the people and not one of our masters. It is a pity that a small developing nation had to be deprived of the skills and experience of Paula Lewellyn because of her age.
The public has debated the issue and has come to its own conclusion as to what has happened. The public has decided who is guilty and who is responsible for misleading the public and hiding crucial information relating to the crime.
This case is going to have a major impact on how people see the prosecutors and the judicial system. They will think about how the system benefits those with money and those with influence.
Remember that a man is not guilty unless proven in a court of law or his plea bargain is accepted in a court of law. Note that a person who pleads guilty could be innocent. There could be others who are guilty by being active participants in the crime or even helping to conceal the crime.
Whatever the court decides will be accepted in law until there is an appeal to a higher court.
Whatever happens in the court, the public court of opinion will make its own judgment. The dilemma is whether there will be a chasm between the court of the land and the people’s court. Only time will tell.
Finally, people have been calling for the police to reopen investigations into the Silveras' son's drowning!

ReplyDeleteWhy did he left her knowing he shot her three times? Know wasn't the seen processed as a crime scene from d day? Who did he call to help him clean her up? Because someone did hence the police didn't see any blood. There are so many unanswered questions. I'm so sorry for those kids I pray they get the help 😔 they will need for their mental health
