STATEMENT BY JAMAICA ON THE ICJ’S PRELIMINARY RULING ON SOUTH AFRICA’S CASE AGAINST ISRAEL

The Government of Jamaica recognizes the ruling by the International Court of Justice (ICJ) on 26^th January 2024, on the case brought by the Republic of South Africa against the State of Israel, as marking a significant development in the Israeli-Palestinian conflict, and more widely in respect of international jurisprudence. Jamaica has long supported the role of the ICJ in the peaceful settlement of disputes and notes that while the substantive claim of genocide is yet to be decided, the Court’s pronouncement on the provisional measures sought is of great importance as, among other matters, it addresses the need for immediate and effective measures to address urgent humanitarian concerns.

 

The Government of Jamaica has been following closely the deeply troubling developments since the 7^th October 2023 attack on Israel by Hamas and the resulting human tragedy in Gaza. We have been particularly concerned and disturbed by the ever-increasing tragic loss of lives, especially of women and children, the taking of hostages and the heart-rending humanitarian crisis of unprecedented scale in Gaza, resulting from the extended hostilities in the region. 

 

It is in this context that Jamaica recalls the UN Secretary-General’s charge that even in the conduct of hostilities, parties to conflicts must act in accordance with international humanitarian law – a point that has been reinforced by the Court. Jamaica also continues to support the Secretary-General’s efforts in calling for an immediate ceasefire to allow for the provision of basic items and to pave the way for a sustainable path towards recovery. 

 

A long-term durable solution to the crisis is imperative and a ceasefire would provide an important avenue for this process to begin. We therefore reiterate the call for the resumption of diplomatic efforts in pursuit of a two-state solution, which, notwithstanding its complexity, we view as the only sustainable solution to the longstanding issues in the region.
