Chairman of the Public Health & Sanitation committee of the St Catherine Municipal Corporation, Sydney Rose, has renewed a call for a Municipal Court system to handle parochial matters across the country.
What we need is not more courts Mr Rose but more effective action. More courts will mean more judges, clerks of the courts and other staff members. This means requiring the already overburdened judicial system to take on more challenges.
Many breaches of the Municipality Acts should be dealt with by issuing a ticket to the person or persons in breach. For example, if you have an illegal building, the council would issue a ticket immediately for that offence. The building owner would have one month to make the appropriate changes or demolish the building. Failing to take such action, the council would demolish the building and the cost for the demolition would be met by the offender. The cost would be levied against the property if the owner refuses to cover the cost.
All of these actions would flow automatically and there would be no need to go to court. The owner would only go to court to dispute the municipality's action. This dispute would have to be lodged within one month with the municipality. The matter would only go to court if the matter cannot be resolved by the complainant and the municipality.

ReplyDeleteI do agree that there are matters that can be and should be managed by the municipality, notices and tickets issued, impartial hearings held, fines paid or where there's no settlement the matter becomes a court case.
ReplyDeleteOf course, how do we ensure partiality, fairness, due process, integrity and a corruption free environment? Accountability, Transparency, Communication, Community Engagement at all levels. It can be done, we have to be committed, it takes time and work!

ReplyDeleteHowever, more awareness of municipal rules and requirements must be disseminated. I know ignorance of the law is no excuse but we also must ensure that the citizens being served are aware of the requirements and their own responsibilities.
In addition, the internal processes of the municipality must be improved to deliver timely responses and or approvals. By doing so we are likely to see improved compliance over time.
Definitely, the sure foundation of any relationship is effective communication and in our wider community we need to be educated on the roles and functions of the various bodies that serve us AND our responsibility as Citizens. Town Hall Meetings, community aids etc. we need to get engaged, creatively, use the technology available, however we must bear in mind that not all of us are tech savvy or connected.
