Can Vehicle Owners Get Seized Vehicles From The Police Now?

I received a report from a citizen stating that people are not being allowed to collect their vehicles from the pound by the police. The report stated further that the person's mother went to collect her car on Tuesday and was given a form at the Pound location. 

She was told to take it to the police station to get the police to sign and stamp it, then the vehicle would be released. At the police station, one police started to fill out the form. Another police said the car would not be released before the court hearing. The vehicle (a registered taxi) was seized because the driver was on the road and was not listed on the carriage licence but in the operating area. No other issues were noted for the seizure of the vehicle. All documents, roadworthiness and operating guidelines were compliant. 

Before certain actions are taken, there must be a change in the law or the relevant regulations have to be changed. I need to know under which authority the Minister gave the directive. The vehicle should be released if the new policy has been legally approved. I will seek clarification from Minister Vaz.

If a vehicle is compliant with the regulations, then the seizure is illegal! That vehicle owner should sue the JCF and the minister of transport and any other relevant parties for loss of revenue, the recovery of all fees and additional expenses and punitive damages for the inconvenience and stress etc.

It is very stressful and costly for vehicle operators when a vehicle is seized. In this case even the Transport Authorities (she went there and checked) stated that the police decision to seize the vehicle was the most extreme of the two options that could have been utilised in that given situation. A ticket fine would have been a reasonable action as those were the two options. She was resolved to paying the fees and court fees on Tuesday when she went to collect the vehicle at the pound under the direction of the public announcement made by the Minister of Transport. However, the police officer at the Mandeville Police station refused to sign the form stating that the car cannot be released until after the court hearing. Even when she showed them the recording of the Minister of Transport directive about citizens being asked to urgently collect their vehicles from the pound, they did not care. So the question now is who does she hold responsible for any damages caused to the vehicle from the hurricane? ( if there is any) as this could have been avoided. Surely government directives are issued with the expectation that those in public offices and it’s citizens will implement and or execute them. This whole situation just causes more stress and unnecessary worry for citizens.

I don’t really reply to post , but here you have an Entitlement issue , the law is clear about the carriage license , your fellow Jamaican will do it again once the car is released.
We have a Law in Ontario about excessive speed , 50 over is considered street racing . It’s instant licence suspension, vehicle is instantly impounded for 28 days don’t matter who or what owns it . But here come the best part , after the 28 days it’s moved from the police pound to a municipal pound pending on the Judge or JP at your hearing it may be released.
Once convicted at the overage speed you car can be CRUSHED . High end Manufacturers like BMW, AUDI and now Tesla will also impose Life time Ban ….plus hopefully the Judge allow you to retain our license or you just have to sit it out for 1- 10 years

Do what again? We do not wish yo live or know the stupid laws of Canada or any other country and do not wish to adopt any of their laws here. Maybe Canada should adopt our morally correct buggery laws and also our right to peacefully assemble in protest instead of seizing truc kers bank accounts for protesting. Canada needs help.
